1. Acceptance of Terms
By downloading, installing, or using the Refract application ("the App") operated by Prism ("we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
2. Description of Service
Refract is a cross-media tracking application that allows users to track, rate, and organize movies, TV shows, and anime. The App also provides social features (profiles, follows, activity feed), AI-powered recommendations, and streaming availability information.
3. Account Registration
- You must sign up using a supported authentication provider (Google, Apple, or Facebook)
- You must provide a unique username during onboarding
- You must be at least 13 years old to use the App
- You are responsible for maintaining the security of your account
- You may not create multiple accounts or impersonate other users
4. User Conduct
You agree not to:
- Use the App for any unlawful purpose
- Post offensive, abusive, or harmful content in comments or list descriptions
- Harass, bully, or intimidate other users
- Attempt to access other users' private data
- Use automated tools, bots, or scrapers to interact with the App
- Reverse-engineer, decompile, or disassemble any part of the App
- Circumvent any security or authentication measures
5. User-Generated Content
- You retain ownership of content you create (lists, ratings, notes, comments)
- By posting content publicly (public lists, activity feed, comments), you grant Refract a non-exclusive, worldwide license to display that content within the App
- We reserve the right to remove content that violates these Terms
- You are solely responsible for the content you post
6. AI Features
- The Discover feature uses Anthropic's Claude AI to generate recommendations based on your queries
- AI-generated recommendations are suggestions only and may not always be accurate
- We do not guarantee the availability, quality, or suitability of recommended content
- Your AI search queries are processed by Anthropic under their usage policies
7. Third-Party Data & Services
- Media information (titles, descriptions, ratings, posters) is provided by TMDB (The Movie Database). Refract is not endorsed or certified by TMDB.
- Streaming availability data is provided by JustWatch. Availability may vary and may not always be up to date.
- Authentication is provided by Clerk. Your sign-in is subject to the terms of your authentication provider (Google, Apple, or Facebook).
- We are not responsible for the accuracy, availability, or content of third-party services.
8. Intellectual Property
- The Refract name, logo, and branding are property of Prism
- Media artwork, posters, and metadata belong to their respective rights holders and are displayed under TMDB's API terms
- You may not use Refract's branding without prior written permission
9. Availability & Modifications
- We strive to keep the App available but do not guarantee uninterrupted service
- We may modify, suspend, or discontinue features at any time without prior notice
- We may update these Terms at any time. Continued use of the App constitutes acceptance of updated Terms
10. Termination
- You may delete your account at any time
- We reserve the right to suspend or terminate accounts that violate these Terms
- Upon termination, your data will be deleted in accordance with our Privacy Policy
11. Limitation of Liability
Refract is provided "as is" without warranties of any kind. To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages
- We are not liable for content posted by other users
- We are not liable for the accuracy of third-party data (TMDB, JustWatch)
- Our total liability shall not exceed the amount you have paid to use the App (if any)
12. Governing Law
These Terms shall be governed by the laws of France. Any disputes shall be resolved in the courts of Toulouse, France.
