Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Refract application ("the App") operated by Prism ("we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Description of Service

Refract is a cross-media tracking application that allows users to track, rate, and organize movies, TV shows, and anime. The App also provides social features (profiles, follows, activity feed), AI-powered recommendations, and streaming availability information.

3. Subscriptions — Refract Pro

• Refract offers optional auto-renewable subscriptions ("Refract Pro") in five cosmetic supporter tiers (Supporter, Spark, Glow, Beam, Prism), available in monthly or annual periods. Refract Pro unlocks cosmetic perks only (rank badge, profile frames, name styles, animated avatars, profile banners). No core features or content are paywalled.
• Payment is charged to your Apple App Store or Google Play account at confirmation of purchase. Prices are displayed in the app, in your local currency, before you buy.
• Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of your selected tier.
• You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Deleting the App does not cancel your subscription.
• Upgrades take effect immediately; downgrades take effect at the next renewal, as handled by the store.
• If your subscription ends, cosmetic items tied to your tier are safely stored and automatically restored if you re-subscribe.
• Refunds are handled by Apple or Google in accordance with their policies; we cannot issue refunds directly for purchases made through the stores.
• We may offer promotional or complimentary access at our discretion; such access may be modified or revoked at any time.
• Subscription prices may change; any change follows the applicable store's notice and consent rules and never applies retroactively.

4. Account Registration

• You must sign up using a supported authentication provider (Google, Apple, or Facebook)
• You must provide a unique username during onboarding
• You must be at least 13 years old to use the App
• You are responsible for maintaining the security of your account
• You may not create multiple accounts or impersonate other users

5. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Post offensive, abusive, or harmful content in comments or list descriptions
• Harass, bully, or intimidate other users
• Attempt to access other users' private data
• Use automated tools, bots, or scrapers to interact with the App
• Reverse-engineer, decompile, or disassemble any part of the App
• Circumvent any security or authentication measures

6. User-Generated Content

• You retain ownership of content you create (lists, ratings, notes, comments)
• By posting content publicly (public lists, activity feed, comments), you grant Refract a non-exclusive, worldwide license to display that content within the App
• We reserve the right to remove content that violates these Terms
• You are solely responsible for the content you post

7. AI Features

• The Discover feature uses Anthropic's Claude AI to generate recommendations based on your queries
• AI-generated recommendations are suggestions only and may not always be accurate
• We do not guarantee the availability, quality, or suitability of recommended content
• Your AI search queries are processed by Anthropic under their usage policies

8. Third-Party Data & Services

• Media information (titles, descriptions, ratings, posters) is provided by TMDB (The Movie Database). Refract is not endorsed or certified by TMDB.
• Streaming availability data is provided by JustWatch. Availability may vary and may not always be up to date.
• Authentication is provided by Clerk. Your sign-in is subject to the terms of your authentication provider (Google, Apple, or Facebook).
• We are not responsible for the accuracy, availability, or content of third-party services.

9. Intellectual Property

• The Refract name, logo, and branding are property of Prism
• Media artwork, posters, and metadata belong to their respective rights holders and are displayed under TMDB's API terms
• You may not use Refract's branding without prior written permission

10. Availability & Modifications

• We strive to keep the App available but do not guarantee uninterrupted service
• We may modify, suspend, or discontinue features at any time without prior notice
• We may update these Terms at any time. Continued use of the App constitutes acceptance of updated Terms

11. Termination

• You may delete your account at any time
• We reserve the right to suspend or terminate accounts that violate these Terms
• Upon termination, your data will be deleted in accordance with our Privacy Policy

12. Limitation of Liability

Refract is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• We are not liable for content posted by other users
• We are not liable for the accuracy of third-party data (TMDB, JustWatch)
• Our total liability shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim

13. Governing Law

These Terms shall be governed by the laws of France. Any disputes shall be resolved in the courts of Toulouse, France.
